Adoptive Leave

Under the Adoptive Leave Acts you may be entitled to 24 weeks adoptive leave, with an additional 16 weeks unpaid if you are adopting a child. Your pension entitlements during maternity leave depend on the nature and terms of your pension arrangement.

If you are a member of a pension scheme, your membership must continue while on statutory adoptive leave. You will continue to accrue pensionable service during the period of statutory leave.

If you have your own personal pension or Personal Retirement Savings Account you may be able to continue contributing provided your total contributions for the tax year are within the limits permitted by Revenue.

If you are paid by your employer during adoptive leave, you may be required to continue paying employee contributions to a pension scheme, if applicable.

For further details of the Adoptive Benefit Scheme, see the Department of Social Protection website www.welfare.ie.
